What is a Medical Power of Attorney?

A Medical Power of Attorney, also known as a Health Care Power of Attorney, is a legal document where you assign another person as your Health Care Agent. The Health Care Agent takes over the responsibility of making health care decisions for you when you are unable to.

 

Do I need a Medical Power of Attorney?

This is ultimately your own decision. A Medical Power of Attorney serves as a safety net in case you may be seriously injured, ill, and/or unable to make decisions regarding your physical and medical condition. Having a Medical Power of Attorney ensures that you appointed a person that you trust to make these decisions for you.

 

Who can I assign as my health care agent?

Anyone of legal age can be your Health Care Agent except for the following:

  • Your healthcare provider;
  • An employee of the healthcare provider unless the person is related to you;
  • Your residential care provider;
  • An employee of your residential care provider unless the person is related to you

It will be beneficial for you if the Health Care Agent you selected is knowledgeable with your wishes, beliefs and whom you have complete trust.
 

Can my health care agent still make decisions for me if I object?

No, you still have complete power over your health care decisions until you are not able to clearly say your own wishes. You can also include in your Medical Power of Attorney the limitations that your Health Care Agent have over you.

 

How can I revoke my Medical Power of Attorney?

You can revoke your Medical Power of Attorney by simply notifying, either orally or in writing, your Health Care Agent and the attending physician(s) and other health care providers.

 

When does the Medical Power of Attorney start to go into effect and when does it end?

Your Medical Power of Attorney is effective immediately after it is executed and you have sent out a copy to your Health Care Agent. The effectivity of the Power of Attorney depends if you have specified a termination date/occurrence, it is revoked, or you became competent.

 

Do I need a witness and a notary?

Yes, you do. In order for your Medical Power of Attorney to be legal, you and two witnesses must sign it in front of a notary public.
